Terms and conditions
The aim of these terms and conditions is to set out the agreement between us (Design Training) and the client.
Agreement with the Client
1) Your training booking
You are booking a trainer to provide you with the training course(s) detailed on the booking form, on the dates specified. Bookings are normally made for a full day (usually 5 - 6 hrs of training), unless other arrangements have been agreed in writing. Training times will be confirmed on the booking form or by email. Bookings are charged at a daily rate or course rate for block bookings.
If training is to be held at your office, home (or at other training room facilities arranged for the training), you are responsible for ensuring that all necessary equipment and software is available and that it is fully functional in time for the training.
Please ensure you have booked the correct course for your needs, and that we have accurate information on the level of training required.
Please give details of any specific training requirements on the booking form or by email.
No responsibility will be accepted for any trainer being unable to provide the exact training you require if you have not provided correct and full information regarding your training requirements before booking the training.
You should notify us as soon as possible of any problem you may have with a trainer or the training. This should happen as soon as possible on the day the problem occurs, and not at the end of a training course.
2) Payment of fees by client
2a) Full payment for the training is required in advance of training start date.
For dates 4 weeks or more ahead: The payment must be received at least 21 days in advance of training start date.
For short notice bookings - booked less than 4 weeks before the training start date: The payment will be due when confirming the booking (1 - 7 days from invoice date - depending on how far ahead the start date is). For very short notice bookings the payment may be required on the same day or the day after the invoice date.
2b) Training dates will not normally be confirmed for you until the payment is received.
2c) Any discounts given will only apply if the payment is received on time.
2d) Travel expenses and any necessary accommodation expenses for on-site training shall be paid by the client on top of the course fees. You will normally be quoted a total cost including all expenses.
2e) Payment must be made directly to Design Training and we will then pay the trainer.
2f) Payment methods
Payment by BACS is preferred.
As an alternative, you may also request to make payment by Credit Card using iZettle Invoice. However this will incur an extra fee to cover the cost of the iZettle payment service. Currently this is 2.5% of the invoice value, and it would add around £15 to a £600 invoice. We reserve the right to change this value if the service fees which we pay change.
2f) Changes to training requirements and additional fees.
We reserve the right in all cases to adjust the cost of the training and invoice for any additional charges, where the client makes significant changes the training requirements after the training has been booked/confirmed or when the trainer arrives to do the training.
This may include: clients requiring a different level of training, wanting to change to a different course, wanting a customised course, adding additional trainees, etc.
3) Late payments
Where payment is made later than the payment due date specified on the invoice, and the training goes ahead, then extra charges may apply and you may lose any discounts which you were given.
We will re-invoice for the increases value and this must be paid in full no later than 14 days after the new invoice date.
3a) Where payment is made later than the due date specified on the invoice, then a higher rate for the training shall apply:
For all training bookings, the amount due will increase by + £50.
3b) Any discounts given will only be available if full payment is received by the payment due date on the invoice.
3c) Where the payment is still not received after the second invoice, any costs resulting from trying to obtain payment will be added to the amount owed. Time spent trying to obtain payment (re-sending invoices or sending reminder invoices, writing emails and letters, making phone calls, etc.) will be charged at £60/hr, in 15 minute blocks (minimum charge £15). Other necessary items such as postage costs, professional fees, etc, will be charged at cost.
3d) Should payment not be received in full within 6 weeks after the payment due date, then legal action may be taken to recover the total amount owed as well as all extra charges and legal costs.
4) Cancellation or rescheduling of training by the client
4a) Requests for cancellation or rescheduling of booked dates must be received in writing a minimum of 21 days before the start date of training. Please also confirm by telephone. If a course or part of a course is rescheduled with 21 days or more notice, there will normally be no extra charges.
If a course is cancelled with 21 days or more notice, you will be entitled to a full refund of the fees paid for each day cancelled, minus a 10% administration fee.
If less than 21 days notice is given then the cancellation charges below will apply.
4b) Cancellation Charges Cancellation charges will apply to all training bookings cancelled or rescheduled 20 days or less before training start date. Where part of a course is cancelled or rescheduled, these charges will apply to each day cancelled or rescheduled.
15 - 20 days before the start of training:
The client will pay 25% of the total value of training, The remainder can be credited towards another booking or refunded.
8 - 14 days before the start of training:
The client will pay 50% of the total value of the training. The remainder can be credited towards another booking or refunded.
7 days or less before the start of training:
The client will pay 100% of the total value of the training. Cancellation on the day of training: The client will pay 100% of the total value of the training.
4c) When cancelling a booking for on-site training the client will pay for any expenses incurred, such as for train tickets or accommodation already purchased. Any other expenses which were included in the training fees will normally be subtracted from the amount due for cancelled or rescheduled days, and added to your credit or refund value.
4d) Where part of a course is cancelled, and discounts were applied to the original booking (e.g. multi-day booking discounts), then the day rate for the cancelled days, and for the remaining booked days may be different, as some discounts may no longer apply.
4e) Where a trainer visiting your office or home is unable to provide you with training because the necessary resources (for example, training space, software or computer equipment) are not available or are not fully functional, this will be treated as a cancellation and full payment for that day will be due.
5) Cancellation or rescheduling of training by us
5a) We will try not to do this unless we absolutely have to, however we reserve the right, in every case, to reschedule or to cancel all or part of a course if necessary. You will usually be given a minimum of 14 days notice with the exception of certain unforeseen or exceptional circumstances. If it does become necessary to reschedule or cancel, you will be entitled to take that course at a later date or receive a refund of fees paid for each day of training cancelled.
5b) Cancellation or rescheduling due to unforeseen or exceptional circumstances We reserve the right, in every case, to cancel or reschedule all or part of a course at short notice due to unforeseen or exceptional circumstances. This may include power failure, train cancellation or strike, vehicle breakdown, exceptional weather conditions, illness or injury. You will have the option to reschedule the course at a later date, or to have a refund of fees paid for each day of training cancelled.
5c) Responsibility will not accepted for any consequential loss arising from cancellation or curtailment of any course by us.
6a) The training will be contracted to one of the freelance trainers who work with us.
All our trainers are very professional and have many years of training experience. Most trainers also have experience of working in the design industry and many trainers do both training and design work.
The trainer may follow a course outline from us or they may follow their own course structure or provide a custom course based on details which the client has provided.
The course details will be discussed with the trainer and client in advance of the training, and details confirmed by email and on the booking form.
6b) Responsibility will not accepted for any loss or damage arising from the actions of any trainer, and any claim should be made directly with the trainer.
