Terms and conditions
The aim of these terms and conditions is to set out the agreement between myself and the client, and where training is subcontracted between myself and the trainer.
Agreement with the client
1) Payment of training fees by client
The prices for training stated on the web site and prices normally quoted
in correspondence, are for early payment. For these early payment rate
to apply, payment must be made as stated below. This applies to all bookings
unless other arrangements have been agreed in writing at the time of
booking.
1a) i) Where training is with myself the payment must be received either
in advance or on the first day of training.
1a) ii) Where training is arranged with another trainer and training is
for 1 or 2 days, the payment can be made immediately after training and
the early payment rate will still apply. Payment must be received in full
within 5 working days
of training start date.
(working days = Mon - Fri).
1b) Bookings of 3 or more days within any 4 week period -
will require
full payment
21 days in advance of training start date (or
payment when confirming, if the booking is made shortly before the training
start date).
If you book a number dates over a longer period, this can be invoiced in
separate blocks if the training sessions are more than 4 weeks apart.
1c) If payment is made later than that stated in section 1a) i) and 1a)
ii) then a higher rate for the training shall apply:
1c) i) for bookings of up to £1000 in value, the amount due will
increase by + £50
1c) ii) for bookings of above £1001 in value, the amount due will
increase by + £75
Where payment is not made as stated in section 1a) i) and 1a) ii) payment
must be made in full at the higher rate as specified in 1c) i) and 1c)
ii) and received in full no later than 30 days after the start date of
training. This applies to all bookings unless other arrangements have been
agreed in writing at the time of booking.
(Training fees and the dates by which payment should be made will be stated
on your booking form as well as the invoice and/or confirmation letter
or e-mail.)
1d) Travel expenses for on-site training will be paid by the client on
top of the course fees, as well as any necessary accommodation expenses.
1e) Any discounts given will only apply if payment is received when due
- as specified on the booking form and invoice. Discounts will no longer
apply if the payment is received later than the specified date, and the
full amount without any discount will then become payable immediately.
2) Late payment of fees
2a) Late Payment Charges:
Late payments will incur a late payment charge, starting with an initial
charge of £15 added 30 days after training start date (or 14 days
after payment due date if special payment arrangements have been agreed)
whichever is later. A further £15 will be added each calendar month
thereafter until payment is received.
Should payment not be received in full within 2 months after the training
has taken place then legal action will be taken to recover the total amount
owed as well as all extra charges and legal costs.
3) Cancellation of a training booking
3a) i) Cancellation by client:
Notice of cancellation must be received in writing a minimum of 10 working
days (Mon-Fri) before the start date of training, please also confirm by
telephone.
3a) ii) Cancellation Charges
Cancellation charges apply to training cancelled less than 10 days before
start date.
Cancellation received 9 working days or less before the start of training:
the client will pay 25% of the total value of training.
Cancellation received 5 working days or less before the start of training:
the client will pay 50% of the total value of the training.
Cancellation received 3 working days or less before the start of training:
the client will pay 100% of the total value of the training.
- It may be possible in some instances to swap dates with someone else
or change a date by one or two days (depending on availability) with no
penalty. -
3a) iii) When cancelling a booking for on-site training the client will
pay for any expenses, such as for train tickets already purchased.
3b Cancellation by us
3b) i) We reserve the right, in every case, to reschedule or to cancel
courses or part of a course as necessary, you will be given a minimum of
10 working days notice with the exception of certain unforeseen circumstances
(see below ). If it does become necessary to cancel, you will be entitled
to take that course at a later date or receive a full refund of any course
fees paid for each day cancelled.
3b) ii) Cancellation due to unforeseen circumstances
We reserve the right, in every case, to cancel or reschedule the course
or part of a course at short notice due to unforeseen circumstances. This
may include power failure, train cancellation or strike, exceptional weather
conditions, illness. You will have the option to reschedule the course
at a later date, or have a full refund of any course fees paid for each
day cancelled.
3b) ii) Responsibility will not accepted for any consequential loss arising
from cancellation or curtailment of any course.
3b) iv) Where part of a day has to be cancelled, any refund will be based
on the % of the day cancelled (normally based on 5½ - 6hrs of training
depending on course)
4) Sub-contracting training to another trainer
4a) Where agreed with the client, certain training jobs may be sub-contracted
to other trainers. The trainer may follow a course outline available
from myself or they may follow their own course structure or provide
a custom course based on details the client has provided. The course
required will be discussed with the trainer and client in advance of
the training.
4b) Payment will be made directly to myself and I will then pass the payment
to the trainer.
4c) Responsibility will not accepted for any loss or damage arising from
the actions of any trainer and any claim should be made directly with the
trainer.
4d) The client should notify me as soon as possible of any problem they
may have with a trainer or the training.
5) Training requirements
No responsibility will be accepted for any trainer being unable to provide
the exact training you require where you have not provided the correct
and full information regarding your training requirements.
Various information applying to both client an trainer
Training times: - the normal training day will be approximately 5½ -
6 hours, usually starting between 9am and 10am
in the morning and usually finishing between 4pm and 4.30pm in the afternoon.
Exact times may vary depending on the course and the requirements of the
client and the trainer. Training times will be confirmed when the training
is arranged.
Agreement with trainer - where training is sub-contracted to another trainer
Before the training is arranged, the trainer will confirm their total price for the job (this must include any agreed travel expenses and accommodation expenses, any extra charges for notes, manuals or books, and any VAT - if they are VAT registered).
The trainer will be responsible for paying all travel and accommodation expenses related to the the training, and where appropriate these expenses should be included in your invoice. Only those expenses previously agreed will be paid, extra fees, costs and expenses which were not stated by the trainer in their price for the job will not be paid.
The trainer should at all times behave in a responsible and professional
manor when dealing with the client and working on the clients premises.
The trainer is responsible for ensuring that they are correctly insured
against any liability claims for damage caused by them while working at
the clients premises.
Payments to the trainer
Payment will be made to the trainer after the training has taken place,
and after an invoice is received from the trainer for the agreed amount.
Payment will normally be made around 14 days after training completion
but may sometimes be slightly later depending on when the payment is
received from the client.
